Terms of Export

These Terms of Export govern all vehicle transactions facilitated by Rockmotion Auto Group LLC. Please read them carefully before engaging our services. By proceeding with any purchase or inquiry, you acknowledge that you have read, understood, and agreed to these terms.

1. Acceptance of Terms

By engaging Rockmotion Auto Group LLC ("Rockmotion," "we," "us," or "our") for vehicle sourcing, purchase facilitation, or export services, you ("Buyer") agree to be bound by these Terms of Export. These terms govern all transactions between Rockmotion and its clients and supersede any prior representations, whether written or verbal.

2. Role of Rockmotion

Rockmotion operates as a licensed used car dealer and broker in the State of Georgia (License No. on file). We act as a facilitator between the Buyer and US-based vehicle sellers, including dealerships, auctions, and private parties. Rockmotion is not the manufacturer of any vehicle and makes no warranty on behalf of any vehicle manufacturer.

3. Vehicle Condition & As-Is Sales

All pre-owned vehicles are sold in "as-is" condition unless a specific written warranty is agreed upon prior to purchase. Rockmotion conducts professional multi-point inspections and VIN history analysis on all vehicles; however, these inspections are provided for informational purposes and do not constitute a guarantee of the vehicle's future performance or mechanical condition. The Buyer acknowledges that used vehicles may have undisclosed defects and accepts this risk.

4. Payment & Transaction Security

Full payment or an agreed-upon deposit is required before a vehicle is reserved, purchased at auction, or prepared for export. Accepted payment methods include domestic and international wire transfer (SWIFT), and other methods confirmed in writing by Rockmotion. All payments are denominated in US Dollars (USD). Rockmotion is not responsible for bank fees, currency conversion costs, or wire processing delays incurred by the Buyer's financial institution.

5. Title Transfer

Vehicle title will be transferred to the Buyer upon confirmation of full payment clearance. For export transactions, Rockmotion will prepare and deliver all required US export documentation, including the Certificate of Title, Bill of Sale, and Export Certificate. The Buyer is responsible for ensuring the title is legally recognized and accepted in their destination country.

6. Export Documentation

Rockmotion will provide the following documentation for all export shipments: original Certificate of Title, Bill of Sale, Export Declaration (EEI via AES), and any additional documentation required by the destination country's customs authority, where applicable. Rockmotion does not guarantee that documentation will satisfy every importing country's specific regulatory requirements. The Buyer is responsible for conducting due diligence regarding import regulations in their jurisdiction.

7. Customs & Import Duties

The Buyer is solely responsible for all customs clearance activities, import duties, taxes, port handling fees, and inland transportation costs at the destination country. Rockmotion does not act as a customs broker in any foreign jurisdiction. We will cooperate fully by providing accurate documentation to support the Buyer's customs clearance process.

8. Cancellations & Refunds

Deposits paid to secure a vehicle at auction or dealer purchase are non-refundable once the vehicle has been purchased on the Buyer's behalf. For vehicles already in our inventory, cancellations made within 48 hours of deposit payment may be eligible for a partial refund, less any incurred transaction or processing fees. No refunds will be issued once a vehicle has been loaded for shipment.

9. Force Majeure

Rockmotion shall not be liable for delays or failure to perform any obligation under these terms where such delay or failure results from events beyond our reasonable control, including but not limited to: port congestion, shipping line schedule changes, acts of government, labor strikes, natural disasters, war, or pandemic-related disruptions.

10. Limitation of Liability

In no event shall Rockmotion's total liability to the Buyer exceed the amount paid by the Buyer for the specific vehicle transaction giving rise to the claim. Rockmotion shall not be liable for indirect, incidental, consequential, or punitive damages of any kind. This limitation applies to the fullest extent permitted by applicable law.

11. Governing Law & Disputes

These Terms of Export shall be governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association.

12. Amendments

Rockmotion reserves the right to update these Terms of Export at any time. The most current version will always be available on this page. Continued engagement with our services after any modification constitutes acceptance of the revised terms.
